Maraga’s Take On Minor’s Consensual Sex Cases.

The head of the Judiciary David Maraga attended the two day Spain-Kenya judge’s seminar that was held on Thursday to discuss the criminal justice system about gender based violence; where he expressed his opinion on how the minors who engage in consensual sex should be dealt with.

Justice Maraga proposed that judges and magistrates should be left to deal with the minors who engage in consensual sex instead of lowering the age limit to 16 or continuing to jail the offenders, hence he feared that the sexual offenses system does not favor the boy child but instead the jails are filled with male teenage offenders; a trend that he advised should be first dealt with.

However, Judge Hannah Okwengu opposed the proposal of changing the current law insisting that lowering the age to 16 would attract sex predators. Judge Njoki Ndungu had also urged women not to support the proposal to change the act because the girls at that age are too young for parenthood.
