NAIROBI, Kenya — The Directorate of Criminal Investigations (DCI) has rejected allegations by Democracy for the Citizens Party (DCP) leader Rigathi Gachagua that the government has captured key state institutions and interfered with criminal investigations.
In a statement issued on Tuesday, hours after Gachagua addressed the media, the DCI maintained that its operations are guided by evidence, the law and its constitutional mandate, regardless of an individual’s political affiliation, status or public prominence.
The agency said it does not sanction, facilitate, conceal or participate in criminal conduct and challenged anyone making such allegations to provide credible evidence.
“No individual is above the law. Neither political affiliation nor public prominence influences the manner in which a criminal investigation is conducted,” the DCI said.
DCI Defends Its Investigative Mandate
The DCI said it is legally mandated to investigate serious and complex crimes, gather evidence and present cases to the relevant prosecutorial and judicial authorities.
It said investigations into alleged abductions, disappearances, deaths, police shootings and other serious offences are conducted based on available evidence and within the law.
The agency rejected claims that its investigations are influenced by political interests, insisting that the outcome of any investigation is determined by evidence and applicable law.

Gachagua Accuses Ruto Administration of State Capture
The DCI statement followed remarks by Gachagua, who accused President William Ruto’s administration of what he termed state capture.
Gachagua alleged that the President had centralised control over key constitutional commissions, state entities, public procurement and the sale of strategic national assets.
He further accused the President of using the presidency to enrich himself and alleged that Ruto had become a US dollar billionaire through the alleged misuse of public resources.
Gachagua also claimed that corruption was thriving under the current administration, alleging that billions of shillings were being lost from public coffers.
DCI Highlights Progress in Murder Investigations
While responding to the allegations, the DCI highlighted progress in several high-profile murder investigations.
The agency cited the ongoing investigation into the killing of PCEA Tabuga Church Reverend Julius Ndumia Ngari in Nakuru North Sub-County.
The DCI also announced the arrest of Oscar Koech Sakong, a suspect linked to the murder of 61-year-old businessman Nathan Masai Wasama.
Wasama was shot dead at his shop in Tuikut Trading Centre, Sasur Location, Cheptais Sub-County.
According to the DCI, Sakong was escorted to Sirisia Police Station as detectives continued pursuing additional leads into the murder.
DCI Warns Against Politicising Tragedies
The investigative agency cautioned against using deaths and other tragedies involving public figures and ordinary citizens to advance political narratives.
It said such actions risk exploiting grieving families and interfering with ongoing investigations.
The DCI further maintained that it would not conduct investigations through the media or disclose sensitive operational information that could compromise ongoing cases.
The agency said that where investigations establish criminal culpability, suspects will be processed in accordance with the law and presented before the relevant authorities.
The DCI urged Gachagua and members of the public with information on alleged criminal activity to submit it through official investigative channels.
It said the information would be assessed and acted upon in accordance with the law, as it continues to work with the Independent Policing Oversight Authority (IPOA), the Office of the Director of Public Prosecutions (ODPP) and the Judiciary.
